Gauss law for continuous charge distribution

gaussian surface can be taken passing through continuous charge distribution.so can a surface of hollow sphere be assumed as a gaussian surface to find field at that point? if you assume so you will get charge enclosed to be zero which says field is zero.but this is not the actual case which says field is kq/R^2
note: gaussian surface is not just above sphere surface...but the surface itself
