Would there really be a chance they would ever set him free without a trial?

Mr Loughner will now be sent for a maximum of four months to a facility where doctors will attempt to treat him.

If he is later deemed competent, the trial will proceed, and if not his detention at the mental health facility can again be extended.

If doctors say they are unable to restore Mr Loughner's competency and a judge rules he cannot be tried, authorities can still petition to have him held.

Common sense...

Jose Melendez-Perez is a Puerto Rican-born United States Customs and Border Protection Inspector at Orlando International Airport who became a key figure for the 9/11 Commission when he refused entry to an alleged terrorist prior to the September 11, 2001 attacks.

When things don't look right, it's always better to err on the side of caution.

If wrong, the lawyers will profit. But at least, no one will be needlessly dead.

pps. The pain was getting too excruciating, and I popped a vicodin that they prescribed for me about two months ago when I was looking like http://en.wikipedia.org/wiki/Vito_Corleone" .

This makes me wonder, in hindsight, why all the non-sense about "calming the national political discourse" came about. The guy was a nutjob that isn't representative of the political discourse in the US.

He won't be set free. And he will eventually be tried if it can be ascertained that he is coherent enough to understand the charged and proceedings against him. Otherwise he can't be tried. Right now his brain is functioning like a laser with it's resonant optical cavity knocked way out of resonance.

He can't be free without the trial. Loughner, the man arrested for a Jan 8 shooting spree in Tucson, Ariz., has been ruled incompetent to stand trial. United States Marshals dragged Loughner out of the courtroom Wed following a mad outburst. http://www.newsytype.com/6698-loughner-incompetent/" . Thus, Loughner will be sent to a federal facility for four months or until doctors are convinced of his competency. His stay can be extended if it is determined he is still not competent after the four-month period. There is no limit to the number of times the stay can be extended.
