How come I don't hear of other people with the surname Einstein? Has this surname been trademarked or copyrighted?

There has been only one brilliant Einstein, same goes for Darwin, Newton, da Vinci, etc. I doubt that name is trademarked/copyrighted so u can change ur last name if u want to.
You might become better at golf if u change ur last name to Woods. :)

I know some "Einsteins," but as far as I know, they're not related to the Einstein.

It's a surname. It can't be trademarked.
