Checking for Xient Inc. Name Availability - Avoid Legal Trouble

AI Thread Summary
To ensure the name "Xient Inc." is not already in use, it's essential to check with the relevant government office that oversees business registrations in your country. In Australia, for instance, the Office of Fair Trading handles this by reviewing proposed business names against existing registrations. In the United States, the process involves checking with the Secretary of State's office and utilizing the US Patent and Trademark Office's resources for a trademark search. It's important to conduct thorough research, especially if planning to expand nationally, as many businesses face challenges when they discover name conflicts after initial registration. Consulting with a legal expert specializing in business law is advisable for those considering operations beyond their local area, particularly in different countries like India, where the registration process may vary.

Well I don't know how it is in India, but over here in Australia there is an Office of Fair Trading and they check it for you.
So you submit your business name registration proposal and they will look at the names of companies in the country. If that name is not being used your registration will be successful, otherwise they get you to keep trying :)
But like I said it will probably be a different system in India, but there should still be a government office that will oversee your registration and let you know if anyone is using that name.

Business do not need to register with the BBB, so the BBB is not the appropriate place to look. The appropriate place to look in the US is the US Patent and Trademark Office: http://www.uspto.gov/ Their site even include a free trademark search.

In the US, you register a new business name in a state by going to the Secretary of State's office.

Here's a little FAQ http://www.olemiss.edu/depts/mssbdc/FAQ.html

I have clients that started out locally and then wanted to go national, only to find out that there is already a company with their same company name registered, so they have had to change their company name.

Here's Alberta, Ca, to give you an idea of differences http://www3.gov.ab.ca/gs/information/clctc/reg_bus_name.cfm

I don't know how you register in India.

If you plan to do business outside of your local area, you should contact an attorney that specializes in this.
